Service of Process on Insurer
In order for an insured or any other party to sue an insurer, a court must obtain personal jurisdiction over the insurer. To accomplish this, an insurer must be served with process in a proper manner. There are several methods of serving an insurer.
Contingent Business Interruption Insurance
Business interruption insurance is a form of property insurance that reimburses a business for losses that arise due to damage to the property of the business that reduces the ability of the business to continue its operations. Contingent business interruption insurance is also available to provide coverage for business continuation losses occurring to a business when property of another business is damaged or destroyed.
Workers' Compensation Insurance
Workers' compensation insurance is acquired by an employer. Usually, the decision to acquire such insurance is made as a choice, mandated by state law, between purchasing workers' compensation insurance or being self-insured through a separately administered and funded plan.
Types of Health Insurance
Health insurance can be organized into three categories. They are disability income insurance, medical cost insurance, and accidental injury or death insurance.
The Duty of Reinsurers to Follow the Fortune of Cedant Insurers
Most reinsurance contracts by which an insurance company cedes or reinsures a portion of the coverage for policyholders to a reinsurer call for the reinsurer to "follow the fortune" of the insurer. Thus, the reinsurer is expected to pay the reinsured percentage of a claim without questioning how the insurer handled the claim. The follow the fortune doctrine is an extension of the "utmost good faith" that by tradition has governed the relationship of the ceding insurer to the reinsurer.
